Seller: Johnnie Banks, trading as Smokestakk Sound Supply (“we,” “us”). Licensing contact: support@smokestakksoundsupply.com Product: Copper Haze — Guitar Vol. I
1. What your purchase includes
This license covers the sample audio delivered with this product when purchased through our official storefront, including our Payhip store. “Samples” includes the supplied recordings and the musical material embodied in them that we own or control. Purchases through another marketplace are governed by the license presented there.
The purchaser receives a worldwide, nonexclusive license for the duration of the applicable rights, subject to these terms. One purchase licenses one individual producer. A business may purchase for one designated producer; additional producers need their own licenses to use the sample library independently. You may keep copies on your own devices and make private backups.
2. Make and release your music
You may incorporate the Samples into new musical productions, including songs, beats, instrumentals, soundtracks, and music for videos, podcasts, advertising, games, film, television, and live performance. You may edit, chop, pitch, stretch, layer, and process them. A Sample can remain unedited within your production; changing it is not a condition of permission.
You may release, sell, stream, perform, monetize, and license those productions commercially or noncommercially. There is no limit on the number of productions, sales, streams, or audience size under this license.
We require no additional sample fees, royalties, publishing share, or credit for permitted uses, including major-label placements and synchronization licenses. You do not need further permission from us for those uses. This does not waive obligations you may have to collaborators or other rights holders for material outside this pack.
3. Ownership and beat sales
We retain our rights in the Samples. Your purchase does not give you exclusive ownership of them, and other customers may use the same sounds. You retain the rights you hold in your original contributions to a production.
You may lease or sell beats containing the Samples, including an exclusive sale of your own contributions. You must not promise exclusivity in the Samples themselves. Your customer may release and exploit the purchased beat under these terms, but may not extract the Samples for unrelated projects or redistribute them as a library.
4. Working with other people
You may provide project files or stems containing Samples to collaborators, engineers, clients, labels, and distributors only as reasonably needed to finish, deliver, or exploit a particular permitted production. Tell recipients that the Samples remain nonexclusive and cannot be extracted for independent reuse or shared as a sample collection. A recipient needs a separate license to use the pack independently in new projects.
5. Uses this license does not permit
You may not sell, give away, upload, trade, or share the Samples as standalone sounds or as a reusable sample collection. This applies to original files and modified versions, including chopped, processed, or renamed versions.
You may not use them to create another sample pack, loop kit, sound library, sample-based instrument, or other product whose purpose is to supply reusable sounds. Releasing an isolated Sample, or a collection of them, under a new track title does not make it a permitted production. You may not share your pack download link, offer shared library access, or transfer the library license to someone else without our written agreement.
6. Content ID and ownership claims
You may not claim exclusive ownership of the Samples or make copyright claims against someone merely because their work uses the same Samples.
Do not submit the Samples as matching references to YouTube Content ID or similar automated claiming services, including within a reference recording where the service prohibits nonexclusive material. Only enroll a production if the service permits it and the Samples can be excluded from matching as required. Otherwise, leave that production out of the claiming service. Ordinary release and monetization remain permitted by this license, subject to the platform’s rules.
If you or a service acting for you makes an improper claim based on these Samples, promptly arrange its release. This license does not guarantee acceptance by a distributor, music library, or automated rights service.
7. Proof and scope
Keep your purchase receipt and this license together as evidence of permission. Artwork, logos, website previews, and demo songs are not licensed as reusable creative assets unless separately stated. No endorsement by Smokestakk Sound Supply is implied.
8. Breach and continuing rights
If you materially breach this license, we may give written notice describing the breach. If it remains unresolved 30 days after notice, we may terminate your license by written notice. You must then stop new uses and remove your reusable copies of the Samples. This does not cancel rights already granted to clients or distributors for compliant productions made before termination, provided their use continues to follow these terms. Remedies for unauthorized sharing or other breaches remain available under applicable law.
The license supplied with your purchase continues to govern that purchase; later website changes do not automatically reduce these rights. Nothing here removes consumer rights that applicable law does not allow to be waived. Refunds and other purchase matters are addressed separately in the store’s sales policies.
